Appeal by Canada from a lower court decision quashing an expropriation order made pursuant to the Expropriation Act, R.S.C. 1985, c. E-21. The expropriation order related to an attempt by Canada to expropriate a parcel of land located at Nanoose Bay British Columbia for national defence purposes. In the lower court judicial review proceeding, the applicant society had alleged certain procedural errors during the expropriation inquiry procedure. On appeal it was held that the procedural errors were not sufficient to justify setting aside the expropriation order. The appeal was allowed. |
