Application for several interim injunctions intended to prevent Canada from completing an expropriation, pursuant to the Expropriation Act, R.S.C. 1985, c. E-21, of land owned by the Province of British Columbia pending the hearing of a constitutional challenge to the expropriation. The intended expropriation was for the purpose of an underwater torpedo testing range. The first application was for an injunction to prevent the inquiry officer from delivering his report to the expropriating authority. The second was to prevent the expropriating authority from confirming the expropriation upon receipt of the inquiry officer's report. The third was to prevent Canada from entering into any leasing agreements with the United States respecting the use of the torpedo testing range. The application was dismissed. |
