Continuation of a compensation hearing before the British Columbia Expropriation Compensation Board pursuant to the Expropriation Act, R.S.B.C. 1996, c. 125. On this application the Board considered whether the Claimant was entitled to recover its costs from the Authority and on what basis. However, to determine this issue, the Board was required to classify the portion of the compensation award made for relocation expenses. A majority of the panel held that the Claimant was entitled to its costs as of right. A dissenting member of the panel concluded that the panel had a discretion regarding costs entitlement. |
