Appeal by the Claimant from a final review of costs conducted earlier by a registrar of the court pursuant to s. 45 of the Expropriation Act, R.S.B.C. 1996, c. 125. At issue on this appeal was the registrar's treatment of interest. It was held that the registrar had properly awarded interest in respect of cost claims submitted pursuant to s. 48(1) of the Act prior to commencement of the compensation hearing in 1995. However, the registrar erred in respect of the award of interest on cost claims submitted after the compensation hearing commenced. The appeal was allowed and the matter referred back to the registrar for reconsideration in light of the court's reasons. |
