Appeal by the City of Calgary from an order of the Alberta Land Compensation Board made pursuant to s. 127(9) of the Municipal Government Act, R.S.A. 1970, c. 246. The Board order under appeal involved a second application by the Respondent for an order compelling the Appellant to expropriate all of the Respondent's leasehold interest. The Appellant alleged that the Board had no jurisdiction to rehear a matter that it had already dealt with on an earlier application. The appeal was allowed and the Board order was quashed. |
