Decision: Application by an owner to the Alberta Land Compensation Board for an order pursuant to s. 127 of the Municipal Government Act, R.S.A. 1970, c. 246, compelling the Respondent City of Calgary to expropriate the entire interest of the Applicant in the lands which formed the subject matter of this proceeding. Prior to commencement of this proceeding the City of Calgary had commenced separate proceedings pursuant to the Expropriation Act, S.A. 1974, c. 27, to acquire part of the leasehold interest of the Applicant in a parcel of land located in downtown Calgary. The Board held that the City's partial taking did not preclude the Applicant from continuing to operate its business from the remaining land if augmented by additional lands in a scheme proposed by the Respondent. The application was dismissed.
