Decision: Appeal by the Claimant from an award of compensation of the Alberta Land Compensation Board pursuant to the Expropriation Act, R.S.A. 1980, c. E-13. The single issue before the Board and now under appeal had been referred back to the Board during a previous appeal. The issue involved the appropriate discount rate to apply to the valuation of gravel extraction potential. On the present appeal, the court held that the appellant had been caught by surprise during the second Board hearing. The matter was referred back to the Board for a third time to be heard by a different panel member.
