Application by the Plaintiff property owner for an order directing the Defendant expropriating authority to produce a further and better affidavit of documents for use in an expropriation proceeding conducted pursuant to the Expropriation Act, S.A. 1974, c. 27. Partial taking of approximately 300 ac. of the Plaintiff's land which totalled in excess of 1,000 ac. before the taking. The land was taken by the Defendant Province of Alberta to establish Fish Creek Provincial Park. On discovery, the Defendant had refused to disclose certain documents citing Crown privilege. The court held that the documents in question should be produced for inspection by the court for the purpose of ruling on whether any or all of such documents should be afforded the privilege claimed by the Defenant. |
