Decision: Application to determine whether the Claimants were entitled to recover costs following a compensation hearing. The Board had previously awarded compensation to the Claimants for increased transportation costs arising from a road closure. On the present application the Board considered whether evidence of pre-hearing settlement offers should be taken into consideration in determining entitlement to costs. The Board determined that the offers were not admissible. It held that the Claimants were entitled to recover actual, reasonable legal, appraisal and other costs and an award was made after several downward adjustments from the amount claimed.
