Decision: Application by the Claimant for an order setting aside a resolution and expropriation bylaw adopted by the Authority. In November 1995, the Authority commenced proceedings pursuant to the Water Act, R.S.B.C. 1979, c. 429, to expropriate a right of way for a water system located on the Claimant's land. The Claimant challenged the validity of the bylaw on the ground that the land was located outside the territorial boundaries of the Improvement District. The application was dismissed.
