Decision: Application by the Claimant to the court for an order awarding damages for losses it allegedly suffered as a result of an abandoned expropriation proceeding conducted pursuant to the Water Act, R.S.B.C. 1996, c. 483. The subject property was located near Radium Hot Springs. The Claimant had previously sought compensation from the British Columbia Expropriation Compensation Board which ruled that it did not have jurisdiction to make such an award. It was held that there was no statutory or common law authority for the compensation award sought. The action was dismissed.
