Decision: Appeal by the District of West Vancouver, a municipal corporation, from an order enforcing an arbitration award of compensation made pursuant to the Municipal Act, R.S.B.C. 1911, c. 170. The matter arose from a by-law adopted by the Appellant which authorized the closing of a portion of Bellevue Street to accommodate a railway project. The Respondents were owners of property located adjacent to the street who had been awarded damages by the arbitrators. The Appellant alleged that the bylaw was invalid and should be quashed. On this appeal the validity of the by-law was upheld and the appeal was dismissed.
