Decision: Appeal by the District of West Vancouver from a lower court decision appointing arbitrators to hear and determine compensation payable to the Respondent. The Appellant, a municipal corporation, had adopted a bylaw authorizing a railway company to construct a railway within Bellevue Street which had the effect of reducing the width of the street from 66 feet to 20 feet. The Respondent owned land adjacent to the 20 foot strip which remained after the railway was constructed. The Appellant alleged that the railway company was liable for any reduction in value to the Respondent's land. It was held that the Appellant was liable for any losses that the Respondent might prove as a result of the reduction in width of the street. The appeal was dismissed.
