Decision: |
Appeal from the taxation of the Respondent's bill of costs following expropriation proceedings conducted pursuant to the Department of Highways and Public Works Act, R.S.B.C. 1960, c. 109 (now the Ministry of Highways and Public Works Act, R.S.B.C. 1960, c. 109). The costs awarded by the Registrar included an allowance of $4,367.78 for appraisal costs. The award for appraisal costs was the only issue on this appeal. It was held that the Registrar did not have jurisdiction to determine expert fees and the matter was referred back to the arbitrator. The balance of the costs awarded by the Registrar were confirmed. |
