Decision: Application to court by the Plaintiffs for an order setting aside an expropriation bylaw and for an order invalidating an expropriation of the Plaintiffs' property. The Plaintiffs alleged that the Defendant had failed to comply with the procedural requirements found in the Municipal Act, R.S.B.C. 1979, c. 290 in that the bylaw did not properly exercise the Defendant's power to expropriate. It was further alleged that notice of the expropriation had not been properly served on all of the affected parties. The application was dismissed with costs to the Defendant.
