Decision: |
Second appeal by the District of Surrey from a trial court order restraining the District from resuming a portion of the Respondent's property for road purposes. The District had purported to resume the land pursuant to the Municipal Act, S.B.C. 1914, c. 52. However, the trial court found that the land in question was exempt from the power of resumption. This order was upheld on the first appeal. The present appeal was dismissed. |
