Decision: Application by the Claimant to the Nova Scotia Utilities and Review Board for an order determining the amount of costs payable to the Claimant pursuant to the Expropriation Act, R.S.N.S. 1989, c. 156. The Board had previously awarded costs to the Claimant following a compensation hearing. The Claimant originally presented a claim for actual costs in excess of $250,000. At the hearing, the claim was reduced to $165,925.85. The Authority took the position that the amount claimed was unreasonable given the complexity of the issues. The Authority proposed payment of $43,125 for legal services relating to the compensation hearing and appeal. The Board awarded $144,582.33.
