Decision: |
Pursuant to an agreement between the parties the Authority acquired the Westville propane distribution plant from the Claimant to permit the expansion of a highway. The parties agreed to refer certain business loss claims to the Nova Scotia Utility and Review Board pursuant to the Expropriation Act, R.S.N.S. 1989, c. 156. The Claimant was the largest marketer and distributor of propane in Canada. Following the taking, the Claimant relocated the Westville facilities. In this action, the Claimant sought compensation for increased property taxes at the relocated premises. The Board held that it had jurisdiction to hear the matter and awarded $369,200 in compensation plus costs to the Claimant. |
