Decision: Application by the Claimant to the Alberta Land Compensation Board to quash expropriation proceedings or alternatively to compel the expropriating authority to comply with the Expropriation Act, S.A. 1974, c. 27. The Authority had served a Notice of Expropriation and a Notice of Proposed Payment upon the Claimants pursuant to s. 29 of the Act. However, the Claimants alleged that the Notice of Proposed Payment did not comply with the requirements of the Act because it was not accompanied by an appraisal of the Claimants' property. The Board held that the Authority had not complied with the Act and granted a declaration to that effect. Costs were awarded to the Claimants.
