Decision: Application by the Claimants to the Alberta Land Compensation Board pursuant to the Expropriation Act, S.A. 1974, c. 27. The Claimants sought a determination that an expropriation was invalid on the grounds that the Respondent had failed to comply with procedural requirements found in the Act. They alleged that the Notice of Proposed Payment had not been served within the applicable time limits. However, the Board found that in serving the Notice the Respondent had complied with an earlier order of the Board. The application was dismissed and costs were awarded to the Claimants.
