Application by the Claimant Eckervogt to the British Columbia Expropriation Compensation Board pursuant to the Expropriation Act, R.S.B.C. 1996, c. 125, for an order determining his entitlement to interest and costs following release of a compensation award in 2001. The issue of interests and costs had been adjourned at that time. The other claimants did not participate in the present application.
The Board determined that the Claimant was entitled to interest on the compensation award at the statutory rate from the date on which he gave up possession of his mineral leases taking into account money paid by the Respondent expropriating authority on account of compensation. The Board also determined that the Claimant had received compensation greater than 115% of the advance payment and was therefore entitled to an award of costs. |
