| Decision: |
Appeal by property owners from a trial court decision on an application for judicial review of a decision of the Respondent Minister of Natural Resources. The Minister's decision involved a refusal to refer a claim for damages to an Arbitration Committee pursuant to the National Energy Board Act, R.S.C. 1985, c. N-7. The Respondent Alliance Pipeline had constructed a pipeline pursuant to an authorization granted for purposes of the Act. The property owners sought damages to their lands arising from the designation by statute of a controlled area adjacent to the pipeline. On appeal it was held that the claims were appropriate for consideration by an Arbitration Committee. The appeal was allowed. |
