Decision: Appeal by the Authority from a compensation award of an Arbitration Committee made pursuant to the National Energy Board Act, R.S.C. 1985, c. N-7. The compensation award was in respect of rights of way acquired by the Authority for an underground natural gas pipeline from the Claimants. It was held that the pattern of dealings approach was applicable. However, the Committee had erred in respect of an award for some of the properties by including a $500 entry fee which was not supported by evidence. The appeal was allowed in respect of this issue and the Committee was directed to reconsider its award. No cost award was made.
