Application to court by the Claimant for an order compelling the Authority to appoint an arbitrator. The Authority had re-graded streets adjacent to the Claimant's property which was located in South Vancouver. The Claimant alleged that the re-grading had damaged her property. She submitted her claim for damages to the Authority pursuant to s. 394 of the Municipal Act, R.S.B.C. 1911, c. 170. However the Authority refused to appoint an arbitrator. The Court held that the Claimant's application was too late, being subject to the one-year limitation in s. 513 of the Act. The application was dismissed. |
