Decision: Application for an interim injunction brought by a property owner against a municipal government. The Plaintiff sought to prevent the Defendant from terminating access from the subject property to an adjacent city street. The Plaintiff operated a restaurant on the subject property. It was held that the Defendant had statutory authority to terminate the access pursuant to The Urban Municipality Act, 1984, S.S. 1983-84, c. U-11. However, the court noted that the Plaintiff might be entitled to compensation for injurious affection under this statute. The application was dismissed.
