Appeal by the claimant from a trial court decision holding that the Appellant's mineral claims had not been expropriated and that the Appellant was not entitled to compensation. The mineral claims were located within an area established by the Province of British Columbia as a provincial park. On the appeal, the court held that the mineral claims had been constructively expropriated and that the Appellants were entitled to compensation to be determined under the Expropriation Act. Costs of the trial and the appeal were awarded to the Appellants. |
