Appeal by the property owner from a compensation award made pursuant to the Expropriation Act, R.S.C. 1906, c. 143. At issue on this appeal was whether the Appellant was entitled to compensation for injurious affection to the land remaining after expropriation. It was alleged that the railway shunting yard which had been constructed on the land that was taken had reduced the value of the remainder. The appeal was allowed and the matter remitted back to the Exchequer Court for reconsideration. |
