Decision: Appeal from the dismissal by a lower court of a previous appeal from an arbitrator's award of compensation. The award of compensation had been made pursuant to the Municipal Act, R.S.B.C. 1911, c. 170. The grade of a city street adjacent to the Appellant's property had been lowered in the course of work done by the Respondent under a local improvement bylaw. The arbitrators had awarded compensation for the damage caused to the Appellant's property. However the arbitrators dismissed a claim for the cost to the Appellant of the local improvement charges levied for the street work. The appeal was dismissed with costs.
