Decision: Application by the Plaintiff for declarations clarifying its liability for the cost of work required to upgrade one of its gas pipelines to accommodate a highway widening project undertaken by the Defendant, City of Surrey. One of the issues arising on the application was whether an order issued by the Oil and Gas Commission authorizing construction of the highway over the pipeline pursuant to s. 31 of the Pipeline Act, R.S.B.C. 1996, c. 364, had the effect of constructively expropriating a statutory right of way interest held by the Plaintiff. It was held that the order did not have this effect.
