Decision: Appeal by a petroleum company from an award of compensation made by the Surface Rights Board pursuant to the Surface Rights Act, S.A. 1972, c. 91. The compensation award pertained to rights of entry granted for the purpose of drilling four gas wells on the Respondent's property. The Board's award had been increased following an earlier appeal to the District Court by the Respondent. The court observed that expropriation principles should be applied when determining compensation under the Surface Rights Act. The appeal was dismissed with costs to the Respondent.
