Application for leave to appeal from a portion of an arbitration award made pursuant to the Forestry Revitalization Act, S.B.C. 2003, c. 17. The Petitioner was a wood products company engaged in timber harvesting. The Respondent Province of British Columbia exercised its power pursuant to the Act to take back certain harvesting rights previously granted to the Petitioner. On this appeal the Petitioner alleged that the arbitrator had erred with respect to an income tax gross-up. Leave to appeal was granted and the appeal was dismissed. |
