Application by a property owner for an injunction to prevent the City and the railway company from interfering with the use of the Plaintiff's property by the erection of a seawall. The Plaintiff owned four waterfront lots in the City of Vancouver. A wharf had been constructed on the foreshore adjacent to the four lots and the wharf was used in the Plaintiff's business as wharfingers. The Defendants planned to construct a sea wall adjacent to the wharf which would have blocked access to the wharf from the ocean. It was held that the Plaintiff had a lawful right to use the foreshore for the wharf and the Defendants did not have a legal right to interfere with use of the wharf. The injunction was granted. |
