Appeal from a lower court order dismissing an action seeking to set aside a municipal bylaw enacted by the Respondent. In 1995 the Respondent amended its Solid Waste By-law. The effect of the amendment was to give the Respondent responsibility for collection and disposal of all solid waste from multi-family residential units in the City of Edmonton. The Appellant had previously conducted a business collecting solid waste from the same residential units. The by-law amendment caused the Appellant's customers to terminate their contracts for solid waste pickup. The Appellant alleged that the by-law amendment had constructively expropriated its business. It was held that the actions of the Respondent did not amount to an expropriation. The appeal was dismissed with costs. |
