Application to court by the Authority to strike out an application for compensation. The Authority had expropriated property in the District of Burnaby in March 1971. One of the Claimants held a mortgage on the subject property at the date of expropriation but did not take steps to submit a claim for compensation to the Authority until October 1973. It was held that the Limitation Act applied and the claim for compensation was too late. The claim was extinguished. |
