Decision: Application by the Defendants for an order striking out the Plaintiff's statement of claim on the ground that there was no reasonable cause of action. The main action sought damages arising from an expropriation by the Province of Saskatchewan of land owned by the Plaintiff. The other Defendants were appraisers who had prepared appraisal reports for use by the Province. It was alleged that the Province and the other defendants had conspired to exclude certain land sales from the appraisals for the purpose of suppressing the amount of compensation to be paid to the Plaintiff. The court held that the claims should be permitted to go to trial for determination. The application to strike out the statement of claim was dismissed with costs.
