Appeal by a landowner from a previous appeal decision setting aside a trial court decision upholding a Pipeline Arbitration Committee's decision awarding costs in proceedings conducted pursuant to the National Energy Board Act, R.S.C. 1985, c. N-7. At issue on this appeal was the jurisdiction of a Pipeline Arbitration Committee to award costs for purposes of s. 99 of the Act. The appeal was allowed. The Pipeline Arbitration Committee's award of costs was restored with costs throughout the appeals awarded on a solicitor-client basis. |
