Appeal by a pipeline operator from an award of costs by a Pipeline Arbitration Committeee pursuant to the National Energy Board Act, R.S.C. 1985, c. N-7. The matter arose from the construction of a pipeline over the subject property. The Respondent property owner had made a claim for reimbursement of expenses for reclamation of the surface following installation of the pipeline. When the Appellant refused to pay the full amount, the claim was submitted to a P.A.C. which awarded compensation and costs to the Respondent. This appeal was brought in respect of the cost award only. The appeal was dismissed with costs to the Respondent. |
