Application by the Plaintiff property owners for a declaration that an expropriation by-law adopted by the Defendant City of Calgary, an expropriating authority, was void for non-compliance with procedural requirements found in the Expropriation Procedure Act, R.S.A. 1970, c. 130. It was held that if there were irregularities they were cured by other procedural provisions of this Act and the Municipal Government Act, R.S.A. 1970, c. 246. The application was dismissed with costs awarded to the Defendant. |
