Appeal by the owner from a lower court decision refusing to set aside an arbitration award of compensation. Partial taking of a 5 ac. portion from two parcels totalling 40 ac. located in the City of Langley. The land was expropriated to permit construction of the Langley By-Pass Highway. The original award had been made by arbitrators appointed pursuant to the Ministry of Transportation and Highways Act, R.S.B.C. 1979, c. 280. The arbitrators had refused to award compensation for injurious affection to the remaining land. The arbitration award was upheld and the appeal was dismissed. |
