Application by the owner to set aside an arbitration award of compensation made pursuant to the Ministry of Transportation and Highways Act, R.S.B.C. 1979, c. 280. Partial taking of a 5 acre portion from two parcels totalling 40 acres located in the City of Langley. The land was expropriated for purposes of the Langley By-Pass highway. The arbitrators had determined that no compensation was payable for reduction in market value to the remaining land. The application was dismissed. Costs were awarded to the Respondent expropriating authority. |
