Application by Chilliwack, an expropriating authority, for leave to appeal a compensation award. The compensation award sought to be appealed was made by the British Columbia Expropriation Compensation Board pursuant to the Expropriation Act, S.B.C. 1987, c. 23. The Respondent owner had alleged that a highway overpass constructed by Chilliwack had interfered with access to the subject property and caused a reduction in market value. The Board awarded compensation which was upheld on an appeal to the British Columbia Court of Appeal. The application for leave was dismissed with costs and without reasons. |
