Decision: Two applications heard concurrently. The first was brought by a property owner for an order enforcing payment of an arbitration award. The second was brought by the Province for an order staying enforcement of the arbitration award pending the outcome of appeals. The Applicant owner had previously obtained an arbitration award in the amount of $9,123,000 as damages for abuse of public office arising from the manner in which the Province had acquired his property. Both parties had appealed the arbitration award. The court granted the Province's application and enforcement of the award was stayed pending the outcome of the appeals.
