Appeal by an owner from a judgment in an action brought by an expropriating authority to enforce an award of costs in a proceeding conducted pursuant to the Railway Act, R.S.C. 1906, c. 37. The judgment provided for recovery of costs in excess of the amount of compensation awarded. On the appeal it was held that the amount recoverable in the cost award was limited to the amount of compensation awarded. The appeal was allowed with costs. |
