Decision: Application for judgment against two Defendants for unpaid appraisal and consulting fees for services provided to the Defendants in an expropriation case. The Defendants had earlier recovered costs for appraisal services from the expropriating authority following a cost review hearing conducted pursuant to the Expropriation Act, S.B.C. 1987, c. 23. However, the Defendants alleged that their obligation to pay the appraisal accounts was limited to the amount reimbursed by the Authority. The court held that the Defendants were liable to pay the portion of the appraisal accounts that exceeded the amount recovered from the Authority. Judgment was awarded in the amount of $16,405.42 plus interest and costs.
