Appeal by the expropriating authority and cross-appeal by the owner from a compensation award made by the Ontario Municipal Board pursuant to the Expropriations Act, R.S.O. 1980, c. 148. The Board had awarded compensation in the amount of $1,724,725 inclusive of amounts for market value of the land taken and injurious affection to the remainder parcel. The appeal was allowed. The compensation award for market value of the land taken was fixed at $247,980 and the claim for injurious affection was returned to the Board for reconsideration. The cross-appeal was allowed to provide for an award of interest. No costs were awarded. |
