Application by the Claimants to the Alberta Land Compensation Board for an order declaring that their claims for compensation were not barred by a limitation. Both Claimants had entered into agreements with the Authority pursuant to s. 30 of the Expropriation Act, RSA 2000, c. E-13. The City alleged that the terms of the agreements imposed a time limitation which had expired before the Application for Determination of Compensation was filed. It was held that the Claimants were not out of time and the declaration was made. Costs were awarded to the Claimants. |
