Appeal by property owners from a lower court decision setting aside an arbitration award of compensation. The arbitration proceedings arose from an expropriation pursuant to the False Creek Reclamation Act, S.B.C. 1911, c. 56. The issue on appeal was whether the arbitrator was correct in taking into account certain riparian rights when determining market value of the land taken. It was held that the subject properties did not enjoy these riparian rights. The appeal was dismissed with costs. |
