Application for an order determining entitlement to costs in a nuisance action. The Plaintiffs had sought damages for noise caused by aircraft using Vancouver International Airport. The Plaintiffs had been successful at the trial of this matter but lost on appeal. The appeal court referred the issue of costs back to the trial court for determination. On the present application, the court apportioned costs between the Plaintiffs and the Defendants and held that both the Airport Authority and Canada were entitled to present separate bills of costs. |
