Appeal by the Claimant from the dismissal by the trial judge of an application to quash an expropriation by-law. The Authority had enacted a by-law pursuant to the Municipal Clauses Act, R.S.B.C. 1897, c. 144, to expropriate the Claimant's land for purposes of the extension of Birdcage Walk located in the City of Victoria. The Claimant alleged several procedural irregularities in the expropriation procedure, including a failure to provide proper notice of council's intention to adopt the expropriation bylaw. The appeal was dismissed. |
