Appeal by the Authority from a lower court decision holding that benefits should be set off against compensation otherwise payable pursuant to the Municipal Act, S.B.C. 1914, c. 52. Partial taking of land to enable construction of a 10-foot wide lane at the rear of the subject property. It was held that the benefits to the remaining land should be set off but not the cost chargeable to the Claimant under the local improvement scheme. The appeal was allowed. |
